Terms of Service

Kashogi is owned and operated by Generic User Acquisition Organization, LLC, a New York company (“Company,” “we,” or “us”). These terms form an agreement when you affirmatively accept them to use a participating feature. You must be 18 or older to accept these terms and use either game.

Please read before accepting. These terms include binding AAA arbitration instead of ordinary litigation for covered disputes, and a proposed $0.10 (ten cents) cap on Company damages where enforceable. Exceptions preserve mandatory legal rights and AAA consumer protections. Reading the site alone does not constitute acceptance.

1. Ownership and your license

Company owns Kashogi’s original website, games, branding, and other materials it creates or acquires. You receive a limited, nonexclusive, nontransferable license to access and use those materials for lawful personal use. Separately identified open-source software, models, videos, and other third-party materials remain subject to their owners’ rights and applicable licenses.

Company does not acquire ownership of your identity, private information, independently created work you have not submitted, or rights belonging to someone else. Rights and licenses granted under previously accepted terms remain subject to those agreements.

2. The experiments and Contact Us joke

The Mars game is a browser arcade adventure with platforming, rocket upgrades, space flight, and a Mars landing. Its cartoon heists involving Mark Zuckerberg and Elon Musk are fictional satire. They do not allege actual conduct or authorize real-world theft, hacking, or taking property. The Contact Us page is satire: it does not offer a contact form, inbox, telephone number, or messaging service. Its buttons show jokes on your screen. They do not send messages to Kashogi or Company.

The Kernel & the Jacket is an unofficial tribute to Terence Tao and Jensen Huang, with eight miniature puzzles inspired by the Lean Kernel Challenge. It does not run Lean or verify universal theorems. Its scores are game points, not official challenge results. Puzzle answers and progress stay in the current page and reset when you reload.

The Thought Thief is a mathematical illusion followed by a local adaptive guessing experiment. It does not read minds, assess your personality, or guarantee prediction accuracy. Your choices remain in the current page, are not submitted by the experiment, and are discarded when you reload or restart the experiment. It uses no cookies or browser storage.

You may use the site for lawful personal purposes. Do not interfere with its operation, attempt unauthorized access, or infringe another person’s rights.

3. Data and retired features

The site no longer offers a public forum or message-submission forms. It does not ask you to publish your name or connection IP. Game progress exists in the current page and resets when you reload. The Contact Us joke does not submit or save a message.

The Oval Office video maker has been retired and no longer creates clips. Previously created scripts and clips remain subject to the terms accepted when they were created, including applicable sharing licenses, third-party rights, and AI disclosure requirements. Previously downloaded voice files may remain in your browser cache until you clear site data.

Records previously created through retired features are not accessible through the public website. Ordinary hosting and third-party services may process request data to deliver and protect the site; the Contact Us joke is not a promise that internet browsing creates no technical records.

4. Dispute notices

The Contact Us page is a joke, not a channel for legal notice. No prior-contact requirement or 30-day waiting period applies while Company provides no functioning dispute-notice channel on this site. The unavailable joke page cannot be used to prevent or delay a lawful claim, arbitration filing, regulatory report, or service of process.

5. Binding AAA arbitration; court and jury waiver

Except for the exceptions below, you and Company agree that disputes arising from these terms or Kashogi will be resolved by binding arbitration administered by the American Arbitration Association under its applicable Consumer Arbitration Rules, rather than by an ordinary lawsuit or jury trial. Rules, filing information, and fee schedules are available at AAA’s consumer information page.

AAA’s consumer fee protections apply. Company will pay the fees and arbitrator compensation assigned to the business by those rules. Hearings will use a method and location consistent with AAA’s consumer rules. The arbitrator may award remedies available under applicable law and must provide a written award.

Either party may bring a qualifying claim in small claims court. This agreement also preserves claims that cannot legally be arbitrated, legally protected court remedies, and court proceedings concerning formation or enforceability of this arbitration agreement or enforcement or review of an award. If AAA declines or ceases administration under its rules, either party may seek resolution in an appropriate court. Company will waive any provision AAA determines conflicts with its Consumer Due Process Protocol as needed for administration.

This clause has not been submitted to or approved by AAA. Company must satisfy AAA’s applicable review and registration requirements. Stating AAA arbitration here does not imply AAA endorsement or guarantee that AAA will administer a dispute.

6. Maximum damages: $0.10

To the fullest extent permitted by applicable law and AAA’s consumer standards, Company’s aggregate liability for claims arising from Kashogi or these terms is limited to $0.10 (ten cents).

This cap does not apply to fraud, willful misconduct, gross negligence, or liability, damages, fees, costs, or remedies that cannot lawfully be limited. It does not restrict the arbitrator’s authority required by AAA’s consumer standards. Where the cap conflicts with those standards or mandatory law, it will not apply. The cap is not a promise that every claim can be limited to ten cents.

7. Service and governing law

Kashogi is offered as available, without warranties to the extent legally permitted. Availability, accuracy, and continued operation are not guaranteed. Statements of opinion, satire, and game results are not professional advice. The Mars game is fictional satire. Mark Zuckerberg, Elon Musk, Terence Tao, Jensen Huang, NVIDIA, and the Lean Kernel Challenge have not endorsed Kashogi.

New York law governs, without displacing applicable mandatory consumer protections. The Federal Arbitration Act governs the arbitration agreement where applicable.

If a provision is unenforceable, it is severed to the extent necessary and the lawful remainder continues. Material changes require renewed affirmative acceptance and will not retroactively change an existing dispute without agreement. Ownership, licenses, and enforceable dispute provisions survive termination.
